Terms of Service and Conditions for LaunchGlimmer

By accessing or using the LaunchGlimmer website (launchglimmer.com) or any of our services, you agree to be bound by these Terms of Service and Conditions ("Terms"). If you do not agree, please do not use our services. These Terms form a legal agreement between you ("Client," "you") and LaunchGlimmer, operated by Mark Keating ("we," "us," "our"). We are based in Ireland, and these Terms are governed by Irish law, including the Consumer Rights Directive, Unfair Terms in Consumer Contracts Regulations, and the General Data Protection Regulation (GDPR).

LaunchGlimmer reserves the right to update these Terms at any time, with changes posted on the website. Continued use after changes constitutes acceptance. If you are a consumer, you will be notified of material changes.

1. Description of Services

LaunchGlimmer provides website design, development, and management services on a subscription basis. Our model includes:


  • Free Website Build: We create a custom, professional, mobile-responsive website for your business at no upfront cost. This includes up to 15 pages, lead capture forms, basic integrations (e.g., social media, Google Maps), and initial setup.


  • Subscription Services: For a monthly fee (€79–€149, depending on the plan), you receive ongoing hosting, SEO optimization, regular updates, security maintenance, and support. Premium plans include e-commerce, advanced SEO, custom integrations, analytics reports, logo refresh, and up to 5 email accounts.


  • Plans are billed monthly via Stripe and auto-renew unless canceled.


We do not provide domain registration as part of the base plan; this is an optional add-on (€10/month, registered in your name). All services are "as is" and subject to availability.

2. Eligibility and Account

You must be 18 years or older and capable of forming a binding contract to use our services. By submitting a form or subscribing, you represent that you meet these requirements. Accounts are non-transferable.

3. Subscriptions and Billing


  • Free Build: No cost or obligation for the initial website build. If you choose not to subscribe, the site will not be activated or hosted.


  • Subscription Plans:


  • Basic Launch (€79/month): Hosting, basic SEO, lead capture, monthly updates, email support.


  • Premium Glimmer (€149/month): All Basic features + advanced SEO, e-commerce (up to 50 products), custom integrations, unlimited updates, 24/7 priority support, analytics, logo refresh, up to 5 emails.


  • Billing: Subscriptions start upon payment confirmation and renew automatically monthly. Prices exclude VAT (23% in Ireland), which is added where applicable. Payments are processed via Stripe. Late payments may incur fees (€10) or suspension.


  • Cancellation: You can cancel anytime with 30 days' notice. No refunds for partial months. Within the 14-day cooling-off period (Consumer Rights Directive), you can cancel for a full refund. Upon cancellation, site access ends immediately, and the website will be deactivated. No transfer of the site or files is provided, as it is a licensed service (see Section 4). Data will be retained for 30 days for export requests (text/images only, fee €50), then deleted.


  • Price Changes: We may adjust prices with 30 days' notice via email.


4. Ownership and Intellectual Property


  • Website Ownership: The website, including code, templates, and design elements, remains the property of LaunchGlimmer. You are granted a limited, non-exclusive license to use the site during an active subscription. Upon cancellation, this license ends, and you lose access to the site.


  • Content Ownership: You retain ownership of content you provide (e.g., text, images, logos). We grant you a license to use any content we create (e.g., custom designs) during the subscription.


  • No Transfer: Websites are not transferable or exportable upon cancellation, as they are part of our subscription service. If you request a buy-out or export, a fee (€500–€1,000, depending on complexity) may apply for HTML/CSS/JS files, subject to our discretion.


  • IP Rights: You grant us a non-exclusive license to use your content for building and maintaining the site. We own all intellectual property in our platform and tools.


5. Client Responsibilities


  • Provide accurate, non-infringing content for your website.


  • Comply with laws (e.g., GDPR for your data processing, no illegal content).


  • Not misuse the site (e.g., spam, viruses). You indemnify us against claims from your content or use.


6. Limitations of Liability


  • Services are provided "as is" without warranties beyond statutory rights. We are not liable for indirect losses (e.g., lost profits, data loss).


  • Liability is limited to the subscription fees paid in the last 12 months.


  • Force Majeure: We are not liable for delays due to events beyond our control (e.g., pandemics, strikes).


7. Termination


  • We may terminate for breach (e.g., non-payment, misuse) with notice. Upon termination, site access ends, and data is retained for 30 days for export requests (fee applies), then deleted.


8. Dispute Resolution


  • Governing Law: These Terms are governed by Irish law. Disputes will be resolved in the courts of Cork, Ireland.

  • Alternative Dispute Resolution: For consumer disputes, you may use the European Online Dispute Resolution platform (ec.europa.eu/odr).


9. Electronic Communications


  • All communications (e.g., emails, notices) are electronic and binding. You consent to receive them at the email provided.


10. Severability


  • If any provision is invalid, the remaining Terms remain enforceable.
